Mediation is the process of facilitating negotiation by two or more people or groups – usually referred to as “sides” – involved in a dispute. The goal of mediation to avoid the stress and uncertainty of taking a case to trial. It is so successful that many courts these days make mediation a mandatory requirement to obtaining a trial setting – meaning, you cannot go to trial until you have attempted mediation, at least, one time.
Kevin Spencer obtained his Mediation Certification from the Center for Public Policy & Dispute Resolution at the University of Texas – School of Law. By doing so, he is allowed to perform and provide mediation services under the laws of the State of Texas. Kevin has practiced law in the area of estate, trust, guardianship and fiduciary litigation for over two decades and has participated many mediation as the attorney for a party. He knows, from the party’s perspective, the qualities that are effective in a mediator and those that are not.
Our office is well-suited for multi-party lawsuits and lunch will be provided for full day meditations. We intend to make you as comfortable with the process as possible and our goal is to arrive at a settlement, but also, if a settlement is reached, to have the parties sign a full and final settlement agreement before they leave the mediation session. Kevin has found that leaving a mediation session with a term sheet, often creates new issues between the parties. Kevin believes that if the parties sit down put forth the effort to finish the settlement completely during the session, it prevents enormous delay and ends the litigation far more easily and sooner. In fact, the pleadings necessary to get the settlement approved with the Court can also be prepared effectively ending the lawsuit the day of the mediation.
Kevin is determined to get the cases he mediates settled and is not interested in wasting anyone’s time in order to meet the pre-requisite for a trial. As a result, Kevin expects all of the parties to attend meditation with a desire for settlement, to work hard to resolve the dispute, and to completely paper it to end the case. He will devote the time necessary before, during and after the mediation session, if necessary, to attempt to get a deal done. Please be prepared to devote the day to the process and to work hard to reach an agreement that resolves the case once and for all.
